Medical Malpractice Case Results

A patient was given the wrong medication following a coronary artery bypass grafting (CABG) surgery and suffered a stroke - John Larkin v. Brookwood Baptist Medical Center, et al. Civil Action Number 2017-903155, Circuit Court of Jefferson County, Alabama

Mr. Larkin underwent a coronary artery bypass grafting (CABG) surgery on his heart at Brookwood Baptist Medical Center. Following the surgery, Mr. Larkin was taken to the recovery room. As he was awakening from general anesthesia and preparing to be extubated, the surgeon ordered an IV push of 50 milligrams of sodium bicarbonates. However, Mr. Larkin was administered an IV push of 50 milligrams of lidocaine. Mr. Larkin's vitals plummeted and he was eventually administered epinephrine to restore his vitals. When Mr. Larkin was awakened and extubated, however, he was diagnosed with a stroke.

Attorney Carter Clay filed a lawsuit on Mr. Larkin's behalf against the hospital and the nurse that administered the wrong medication. The claims involved allegations of negligence related to administering the wrong medication and an allegation that the lidocaine caused Mr. Larkin to sustain a stroke. As a result of the stroke, Mr. Larkin was left with permanent, disabling injuries.

After extensive discovery was conducted, including the taking of multiple depositions, the case was resolved for a confidential amount in 2019 at mediation.

Estate of Arthur Perryman vs. SafetyNet Academy (Circuit Court of Dallas County, Alabama)

Arthur Perryman was an 18-year old resident of SafetyNet Academy, a residential treatment and educational facility for boys with psychiatric problems. It was alleged that Arthur became ill and that the Academy personnel failed to get him medical treatment in a timely manner and that this failure resulted in his death.

A wrongful death case was filed on behalf of the Estate of Arthur Perryman and in January of 2011, the case was tried and the jury returned a verdict in favor of the Estate and awarded $3.5 million.
